1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Mobiliser platform ("Platform"), operated by Peoplewise Technologies Limited ("Company", "we", "us"), a company registered in England and Wales with the Companies House in the United Kingdom.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Description

Mobiliser is a community engagement and mobilisation platform designed for political campaigns and community organising. The Platform provides features including but not limited to:

  • Organisation and movement management with hierarchical structures.
  • Social feed with posts, polls, comments, and content sharing.
  • Event creation, management, and RSVPs.
  • Direct and group messaging.
  • Location-targeted broadcast communications.
  • Administrative dashboards and analytics.
  • Wallet and financial transaction management.
  • Push notifications and email communications.

5. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Post, share, or transmit content that is defamatory, obscene, threatening, abusive, hateful, or that incites violence.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform.
  • Attempt to gain unauthorised access to any part of the Platform, other accounts, or computer systems.
  • Use automated means (bots, scrapers, crawlers) to access the Platform without our express written permission.
  • Upload viruses, malware, or other malicious code.
  • Harvest or collect personal information of other users without their consent.
  • Circumvent any content moderation or censorship measures applied by administrators.

6. Content

6.1 Your Content

You retain ownership of content you create on the Platform (posts, comments, messages, media). By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with operating and providing the Platform.

6.2 Content Moderation

Organisation administrators and leaders may moderate content within their organisations, including censoring posts that violate community guidelines. Censored content remains visible to the author but is hidden from other users. We reserve the right to remove any content that violates these Terms.

6.3 Content Restrictions

  • Posts are limited to 5,000 characters; comments to 1,000 characters.
  • File uploads are limited to 10 MB (general), 5 MB (images), and 100 MB (video).
  • Content must comply with the laws of England and Wales, as well as the laws of Nigeria where applicable.

7. Organisations and Roles

The Platform supports a hierarchical role system including Platform Administrators, Movement Administrators, Organisation Administrators, Leaders, and Chairmen. Each role carries specific permissions and responsibilities. By accepting an administrative or leadership role, you agree to:

  • Exercise your role responsibly and in accordance with these Terms.
  • Respect the privacy and rights of members under your jurisdiction.
  • Use administrative tools (content moderation, broadcasts, analytics) for their intended purposes only.

8. Financial Transactions

The Platform includes wallet functionality for users, organisations, and movements. All financial transactions are subject to applicable laws and regulations. We are not a financial institution and do not provide banking services. Transaction records are maintained for audit and compliance purposes.

9. Notifications and Communications

By using the Platform, you consent to receiving service-related notifications via in-app messages, push notifications, and email. You may manage your notification preferences through the Platform settings. Certain critical service communications cannot be opted out of.

10. Intellectual Property

The Platform, including its design, features, code, and branding, is the intellectual property of Peoplewise Technologies Limited. You may not copy, modify, distribute, or create derivative works of the Platform without our express written permission.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We are not responsible for the accuracy or reliability of content posted by users.

13. Limitation of Liability

To the fullest extent permitted by law, Peoplewise Technologies Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.

14. Indemnification

You agree to indemnify and hold harmless Peoplewise Technologies Limited, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Platform or violation of these Terms.

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
